***Must be cited using Australian Guide to Legal Citation 4th Edition*** The Client Interview and Advice – Part 1 assessment (worth 20%) will test your demonstrated problem solving, and understanding of the torts covered in the unit modules from weeks 1 to 2 and/or 3 – namely, Introduction and Trespass (General Principles and the Classification of Torts; Trespass to Person and Land; Trespass Defences, Remedies and Limitation of Actions) and/or Nuisance (Private Nuisance): see the \”Lecture Timetable\” heading at 11.1 of the Introductory Guide to the LLB102 Torts Study Guide and Torts Assessment by Lecture Topic The assessment will require students to advise the partner of a hypothetical law firm on the possible actions in tort (as per the instructions) arising out of a client’s written statement and to identify what further legally relevant information is required from the client (and why it is required with reference to relevant law) so that a full and proper advice can be given. In this part of their answer, students must adopt the ISAAC ISAACS problem solving methodology in order to: identify the elements and issues relevant to each action, defence or remedy relevantly raised by the client’s statement; state the law relevant to each element / issue; and apply it to the information provided to reach a conclusion on each element / issue or, more importantly for this item of assessment, to identify (where a definite conclusion is not possible) what further legally relevant facts are required to enable a conclusion to be made. This assessment will also assess students’ knowledge of legal interviewing and their ability to articulate (in the form of written questions) the further legally relevant facts or information required from the client at interview in order to advise them correctly. For each question, students will be required to classify the type of question asked. Students will be required to write up their advice for the client\’s file. Student answers must be written in essay style (connected prose) and correctly referenced. As such, students’ written communication and referencing skills will also be assessed. This is not an oral assessment piece.
